1. Agreement to these Terms
These Terms of Service govern access to and use of Tamper websites, dashboards, point-of-sale tools, online ordering, AI-assisted website generation, customer relationship tools, loyalty, inventory, analytics, billing, support, and related services. By creating an account, joining an onboarding flow, using the dashboard, or accepting an order through Tamper, you agree to these Terms on behalf of yourself and the business you represent.
If you use Tamper for a company, café, franchise group, or other organization, you represent that you have authority to bind that organization. If you do not agree, do not use Tamper.
2. Accounts and authorized users
You are responsible for maintaining accurate account information, protecting credentials, assigning appropriate staff permissions, and all activity under your account. You must promptly notify Tamper of suspected unauthorized access or security incidents affecting your account.
- Use strong passwords and unique staff logins where available.
- Keep business, tax, payout, menu, pricing, and location information accurate.
- Do not share owner-level access with people who are not authorized to act for your business.
3. Platform usage
Tamper provides software for café operations. You remain responsible for your products, menu descriptions, prices, taxes, customer promises, employee practices, inventory, allergen disclosures, regulatory compliance, and fulfillment of orders.
Tamper may modify, add, suspend, or discontinue features to improve reliability, comply with law, prevent abuse, or support new services. Material changes that reduce paid functionality will be communicated as described in the legal versioning section of these Terms.
4. Payment processing and subscriptions
Paid plans, order payments, invoices, hardware charges, and add-ons may be processed by Stripe or other payment providers. By submitting payment information, you authorize Tamper and its payment processors to charge applicable fees, taxes, usage charges, setup fees, hardware costs, and renewal amounts.
Subscriptions renew automatically for the billing period shown at checkout or in the dashboard unless canceled before renewal. You are responsible for chargebacks, refunds, reversals, disputes, taxes, and any fees caused by inaccurate business or bank information.
5. AI-generated content disclaimer
Tamper may use artificial intelligence providers, including OpenAI, to help generate website copy, menu descriptions, customer messages, operational suggestions, and analytics summaries. AI outputs may be inaccurate, incomplete, outdated, offensive, or unsuitable for your business without review.
You are responsible for reviewing, approving, editing, publishing, and using AI-generated content. Tamper does not provide legal, tax, medical, nutrition, employment, accounting, or food-safety advice through AI features.
6. Acceptable use
- Do not use Tamper for unlawful, deceptive, harmful, infringing, harassing, discriminatory, or abusive activity.
- Do not upload malware, attempt unauthorized access, probe systems, bypass rate limits, interfere with service integrity, or reverse engineer non-public components except as allowed by law.
- Do not send spam, phishing, fraudulent promotions, misleading customer messages, or content that impersonates another business or person.
- Do not use Tamper to sell illegal goods or services, violate food, alcohol, labor, tax, sanctions, privacy, or consumer-protection rules, or process transactions you are not authorized to accept.
- Do not submit sensitive personal information unless Tamper expressly supports and requests it for the feature you are using.
7. Customer content and data ownership
You retain ownership of menus, branding, customer lists, transaction records, staff information, and other content you submit to Tamper. You grant Tamper a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, analyze, and otherwise use that content as necessary to provide, secure, improve, and support the services.
Tamper may use aggregated or de-identified data to understand product performance, benchmark operational patterns, improve AI features, and publish non-identifying insights.
8. Third-party services
Tamper integrates with third-party services such as payment processors, messaging providers, AI providers, hosting providers, analytics services, and business tools. Third-party services are governed by their own terms and privacy notices. Tamper is not responsible for third-party services outside its reasonable control.
9. Suspension and termination
You may stop using Tamper or cancel paid services through the available account controls or by contacting support. Tamper may suspend or terminate access if you breach these Terms, fail to pay amounts due, create legal or security risk, misuse the services, or if continued service becomes impractical or unlawful.
After termination, you remain responsible for outstanding fees, disputes, chargebacks, taxes, and obligations that by their nature should survive termination. Tamper may retain data as described in the Privacy Policy and applicable law.
10. Disclaimers
The services are provided “as is” and “as available.” To the maximum extent permitted by law, Tamper disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, error-free operation, and that outputs or data will be complete or accurate.
11. Limitation of liability
To the maximum extent permitted by law, Tamper will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for lost revenue, lost data, lost goodwill, business interruption, or substitute services. Tamper’s total liability for all claims arising out of or relating to the services will not exceed the greater of $100 or the amounts paid by you to Tamper for the services giving rise to the claim during the three months before the event giving rise to liability.
12. Indemnification
You will defend, indemnify, and hold harmless Tamper from claims, damages, liabilities, costs, and expenses arising from your content, products, services, customers, employees, violation of these Terms, violation of law, or misuse of Tamper.
13. Governing law
These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration agreement below.
14. Dispute resolution and arbitration
Before filing a claim, the parties will try to resolve disputes informally by sending written notice to the other party and allowing 30 days for good-faith negotiation. If unresolved, any dispute arising out of or relating to these Terms or the services will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, unless another mutually agreed forum is required by law.
The arbitration will occur in Delaware or remotely by video conference. Each party waives the right to a jury trial and to participate in class, collective, consolidated, private attorney general, or representative actions, except where prohibited by law. Either party may seek injunctive or equitable relief in court for unauthorized use, intellectual property misuse, or security abuse.
15. Changes to these Terms
Tamper versions legal documents by effective date. For material changes, Tamper will provide notice by email to account owners and/or in-product notice before the changes take effect when required. Continued use after the effective date means you accept the updated Terms.
